We will not be responsible for disruption or non-availability caused by matters outside Our reasonable control, including hosting or communications failures, power failures, network disruption, maintenance, natural events or legal restrictions.
We reserve the right to suspend, withdraw, amend or restrict the availability of all or part of the Website where reasonably necessary for operational, security, regulatory or legal reasons.
8. LINKS TO OTHER WEBSITES
The Website may contain links to third-party websites, including websites operated separately from www.totalbodycare.co.uk.
Unless expressly stated otherwise, third-party websites are not under Our control. We are not responsible for their content, availability, privacy practices or the goods or services they provide. The inclusion of a link does not necessarily constitute Our endorsement of that website.

10. WEBSITE CONTENT
We take reasonable care to ensure that information provided on the Website is accurate and up to date. This includes product descriptions, specifications, pricing, delivery information and product imagery.
Many of the Goods offered for sale are manufactured by third parties. Product descriptions, specifications and images are therefore provided to help customers identify and understand the Goods and may be based on information supplied by manufacturers or distributors.
Product images are intended to provide a reasonable representation of the Goods. Colours and packaging may vary depending on your device, manufacturer packaging changes or other factors outside Our control.
Availability of Stock: We make reasonable efforts to maintain accurate information about stock availability. Occasionally, discrepancies may occur. If you order an item displayed as available which is subsequently found to be unavailable, We will notify you as soon as reasonably possible.
Website Content may be corrected, updated or changed without prior notice where appropriate.

You are responsible for maintaining the confidentiality of your Account credentials. If you believe another person has obtained unauthorised access to your Account, please contact Us as soon as possible.
We reserve the right to suspend or terminate an Account where We reasonably believe it has been used fraudulently, unlawfully or in breach of these Terms and Conditions.
12. TERMINATION & CANCELLATION OF ACCOUNTS
You may stop using your Account at any time. We may suspend or terminate an Account where reasonably necessary, including where these Terms and Conditions have been breached or We reasonably suspect fraudulent or unlawful activity.
Termination of an Account will not affect rights or obligations relating to orders already accepted unless the relevant order is also lawfully cancelled.
13. TERMS & CONDITIONS OF SALE
Products displayed on the Website constitute an invitation to purchase and not a contractual offer by Us.
After placing an order, you will receive an automated email acknowledging that We have received your order. This acknowledgement does not mean that your order has been accepted.
Your order constitutes an offer to purchase Goods from Us. The contract between you and Us is formed when We send confirmation that the Goods have been dispatched (the Dispatch Confirmation).
The contract will relate only to the Goods included in the Dispatch Confirmation. Where an order is dispatched in more than one shipment, separate Dispatch Confirmations may be issued.
We may be unable to accept an order for reasons including:
- the Goods being unavailable;
- an error in the price or description of the Goods;
- Our inability to obtain authorisation for payment;
- suspected fraudulent or unlawful activity; or
- restrictions affecting the sale or delivery of the Goods.
If We are unable to accept an order, We will notify you and any payment already taken for Goods that will not be supplied will be refunded.
We reserve the right to withdraw Goods from the Website or amend product information at any time.
14. CONSUMER RIGHTS
If you are purchasing as a consumer, you have statutory rights in relation to Goods purchased from Us. Nothing in these Terms and Conditions affects those statutory rights.
In addition to your statutory rights, We offer the returns arrangements described in Our Returns Policy below.
15. DELIVERY
We aim to dispatch all orders as soon as possible and within 48 hours of receiving payment. UK Standard Delivery normally arrives within 3 to 5 working days after dispatch.
For more details about delivery rates and estimated delivery times, please refer to Our Delivery Guide.
Orders may be processed and dispatched from different fulfilment locations depending on stock availability and operational requirements.
Occasionally, delivery may take longer due to carrier disruption, adverse weather, supplier delays or other circumstances outside Our control. Unless exceptional circumstances apply, orders will be delivered within 30 calendar days of the Dispatch Confirmation.
The risk in the Goods shall remain with Us until they come into your physical possession.
If Goods are ordered from outside the United Kingdom, import duties, taxes or other charges may be incurred when the Goods reach their destination. We are not responsible for these charges and cannot calculate or estimate them in advance.
16. PRICE & PAYMENT
The price of Goods will be as displayed on Our Website, except in cases of obvious error.
Unless otherwise stated, prices include VAT where applicable but exclude delivery charges. Applicable delivery charges will be shown during checkout.
Prices may change from time to time. Changes will not affect an order for which a contract has already been formed.
Despite Our reasonable efforts, it is possible that a product may occasionally be incorrectly priced. If We discover an obvious pricing error before accepting your order, We may contact you for instructions or reject the order and notify you.
We are not obliged to supply Goods at an incorrect price where the pricing error is obvious and could reasonably have been recognised as an error.
Payment must be made using one of the payment methods offered at checkout. Available payment methods may change from time to time.

Where Our Website operates a loyalty rewards programme, the following general conditions apply:

- We reserve the right to amend or terminate the loyalty rewards programme, subject to applicable law.

If an item is unwanted, you are responsible for the cost of returning it unless We agree otherwise. Your original delivery charge will not normally be refunded for an unwanted-item return, except where required by law.
Different arrangements apply where Goods are faulty, damaged in transit or do not match what you ordered, as explained below.
Please package returned Goods securely and include your invoice, delivery note or sufficient information for Us to identify your order.

Returns Information - Full Policy
We aim to provide Goods that are of satisfactory quality, as described and free from defects. If there is a problem with Goods supplied by Us, please contact Us as soon as reasonably possible at [email protected] or on +44 (0)20 3092 2766.

If Goods arrive damaged, please contact Us as soon as possible and provide details of the damage. We may request photographs or other reasonable information to help Us investigate the issue and arrange a replacement, return or refund as appropriate.
Where Goods have been damaged in transit, We will be responsible for reasonable return costs.
Faulty Goods
If Goods are faulty, not as described or otherwise do not conform to your statutory rights, please contact Us. Your rights in relation to faulty Goods are not affected by Our voluntary 30-day returns policy.
Depending on the circumstances and your statutory rights, an appropriate remedy may include a refund, repair or replacement.
Unwanted Goods
If you change your mind about Goods, please notify Us within 30 days of receiving them and return eligible Goods within the applicable returns period.
Unwanted Goods must be returned unopened, unused and in a resaleable condition with all relevant seals, packaging and cellophane intact where applicable.
You are responsible for the cost and safe return of unwanted Goods. We recommend using an appropriate tracked service and retaining proof of postage until your return has been processed.
Goods That Cannot Be Returned Following a Change of Mind
Some Goods may be excluded from change-of-mind returns where permitted by law. This may include:
- Goods made to your specifications or clearly personalised;
- sealed Goods that are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery; and
- other Goods for which a statutory exception to cancellation rights applies.
This does not affect your statutory rights where Goods are faulty, damaged, incorrectly supplied or otherwise do not conform to the contract.
Refunds
Approved refunds will normally be made using the same payment method used for the original purchase. Where this is not reasonably possible, We may agree an alternative method with you.
We will process refunds within the periods required by applicable consumer law. We may, where permitted by law, wait until We have received the returned Goods or you have supplied evidence that the Goods have been sent back before issuing a refund.
19. OUR LIABILITY
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by Our negligence, fraud or fraudulent misrepresentation.
We are responsible for foreseeable loss or damage caused by Our breach of these Terms and Conditions or Our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
If you use Goods or the Website for commercial or business purposes, additional limitations may apply and you should contact Us regarding the applicable business terms.

We may transfer Our rights or obligations where permitted by law, provided that doing so does not adversely affect your rights under the contract.
23. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for a failure or delay in performing Our obligations where this is caused by circumstances outside Our reasonable control.
Such circumstances may include industrial action, disruption to transport or communications networks, severe weather, natural disasters, epidemics, acts or restrictions of government, interruptions to utilities, carrier disruption or other events beyond Our reasonable control.
Where such an event affects an order, We will take reasonable steps to minimise the effect of the disruption and fulfil Our obligations as soon as reasonably possible.
